Anti-Spam Policy
Agency SMS Gateway anti-spam and acceptable messaging rules covering consent, opt-outs, prohibited lists, carrier safeguards, client responsibility, and enforcement.
Effective date: September 15, 2026
Agency SMS Gateway is intended for legitimate, permission-based business messaging. This Anti-Spam Policy applies to every agency, sub-account, client deployment, user, phone number, device, campaign, automation, and API workflow using the service.
1. Permission-based messaging is required
You must have an appropriate legal basis and, where required, valid consent before sending marketing or automated SMS. Keep records showing how and when recipients opted in. Do not assume that possessing a phone number automatically gives permission to send promotional messages.
2. Prohibited list practices
- No purchased, rented, scraped, harvested, or randomly generated phone-number lists.
- No importing a third-party list when you cannot document the source and messaging permission.
- No repeatedly messaging old contacts who have not reasonably agreed to receive the type of messages you are sending.
3. Opt-outs must be honored
ASG supports common opt-out handling such as STOP, END, CANCEL, QUIT, and UNSUBSCRIBE, plus supported START/resubscribe behavior. You must honor opt-outs promptly and must not move opted-out recipients to another number, SIM, account, or campaign to avoid their request.
4. Do not evade carrier safeguards
You may not rotate numbers, SIMs, devices, domains, links, or accounts to evade carrier filtering, suspension, opt-out protections, complaint controls, or platform restrictions. Attempts to bypass safeguards may result in immediate suspension.
5. Prohibited message content
Do not use ASG for unlawful, fraudulent, deceptive, threatening, harassing, phishing, malware, impersonation, or scam messaging. You are also responsible for complying with wireless-carrier restrictions and any industry-specific rules that apply to your campaigns.
6. Keep complaint and opt-out rates low
Monitor delivery, replies, complaints, and opt-out activity. The platform includes opt-out-rate protection and other messaging safeguards. A high opt-out rate is a signal to stop, review consent and targeting, reduce frequency, and correct the campaign before continuing.
7. Identify the sender
Messages should make the business identity clear when it would not otherwise be obvious. Do not mislead recipients about who is contacting them or why.
8. Respect timing and frequency rules
Follow applicable quiet-hour, frequency, consent, disclosure, and recordkeeping requirements. U.S. users should understand their TCPA and carrier obligations; users in other countries must follow the laws that apply to their recipients.
9. Agency responsibility for clients
Agencies are responsible for the messaging behavior of client deployments and sub-accounts they manage. Provide client training, establish acceptable-use rules, and act quickly when a client creates legal, carrier, or reputation risk.
10. Enforcement
We may investigate suspected abuse and may pause, limit, or terminate access when messaging creates legal, carrier, security, platform, or reputation risk. Carrier actions may occur independently of ASG and are outside our direct control.
To report suspected abusive messaging involving Agency SMS Gateway, email hello@agencysmsgateway.com with the sending number, date/time, message content, and any screenshots you can provide.
